“This petition arises from the government’s systematic denial of Petitioner’s CVRA rights
in connection with the landmark antitrust case against Google. On January 4, 2024, Petitioner filed multiple motions containing evidence of additional antitrust violations and conflicts of interest involving the presiding judge’s first cousin’s employment relationships with Google. These documents were “carried away” from the clerk’s office by Deputy Clerk Erica Duncan before being properly docketed, preventing both the Department of Justice and 38 state attorneys general from receiving crucial evidence.
“The removed documents contained evidence that Judge Mehta’s first cousin, Chirag Mehta, while at Oracle, partnered with Judge Mehta’s “close friend” Rao at Google to implement anticompetitive “no-poach” agreements in 2007. After being terminated from SAP amid bribery investigations, Chirag was hired by Google in 2017, only to leave in February 2021 shortly after Judge Mehta disclosed this relationship. In May 2022, Chirag became Chief Product Officer at Zipline, backed by Google and Baillie Gifford Fund. A month later, Judge Mehta purchased $50,000 in Baillie Gifford Fund shares, after which the fund dramatically increased its Alphabet holdings.When Petitioner attempted to bring this evidence to light through proper judicial channels, the district court issued a pre-filing injunction without notice or hearing. Petitioner sought mandamus relief under the CVRA, but the panel summarily dismissed the petition as moot without addressing its merits.”
